Warranty Information

1) WARRANTY & LIABILITY

Except as otherwise provided, TransAfrica Water Systems Ltd (here-in after called the Company) warrants to the customer that the equipment sold hereunder, is new equipment and is, at the time of delivery to the customer from the Company, free from defects in material and workmanship. As the customer’s sole exclusive remedy under this warranty the Company agrees either to repair or replace, at the Company’s sole option, any part or parts of such equipment, which under proper and normal conditions of use prove to be defective.

2) The warranty period commences after the product has been delivered, or when installed by the Company and at it’s expiry all liability ceases. Equipment shall be deemed delivered as soon as it is made available to the client.

4. The Company will be under no liability in respect of any defect in the product arising from; Normal wear and tear; Accidental or willful damage or misuse;Incorrect installation; Incorrect application; Lack of maintenance; The use of products with liquids containing sand,salt or harmful chemicals.The use of faulty auxiliary equipment inconjunction with the Product; Abnormal operating conditions; Pump running dry; Lightning or other circumstances beyond the Company’s control; Any repair or attempt at repair carried out by any other party invalidates all warranties.

5) The Company will be under no liability in respect of any defect in the Product arising from; Inadequate motor protection; Installations involving temporary connections; When a motor has operated with power supply beyond the manufacturers specified limits and tolerances for frequency, current, voltage and phase symmetry; When there is evidence of incorrect connection to the power supply.

6) The Company will be under no liability in respect of any defect in the product arising from;
i. Any drawing, design or specification supplied by the customer/purchaser
ii. Modifications undertaken by the customer/purchaser or a third party without the consent of the TransAfricaWater Systems Ltd

7) The Company will be under no liability in respect of any defect in the product arising from wear and tear due to usage or where parts replacement will be required for routine maintenance of the equipment (e.g filter catridges, sand media, chemicals and other consumables.

8) The Client will notify the Company immediately after becoming aware of any defect in the Products and will provide authority for Company employees to inspect the Product. Proof of purchase in the form of the original invoice is required before warranty is authorized. Warranty of new equipment that fails within the warranty period and is not fully paid for as per the agreed terms of payment will not be honored.

9) The warranty on equipment installed by others is subject to the faulty unit being promptly returned to our workshop and collected thereafter when repaired. The warranty does not cover the cost of transport, labor or removal of the equipment from the site.

10) The warranty period for repair work is 3 months from the date of delivery or installation by the Company. This only applies to parts replaced during repair.

11) For new installations the warranty will be 6 months from date of commissioning except for claims for repair or replacement of defective parts in accordance to (Clause 1 and 3), for which the standard warranty period applies. Labour and transport will be chargeable for all warranty repairs or replacements executed after expiry of the 6 month warranty for new installations.

12) For new installations labour and transport will be charged if the defect is examined to be caused by factors not related to the installed equipment.

13) Products which are repaired or replaced by TransAfricaWater Systems under the provisions of these limited warranty terms will continue to be covered by warranty only through the remainder of the original warranty period set forth by the original purchase date.

14) FORCE MAJEURE. Seller shall not be responsible for any loss or damage, including liquidated damages
resulting from any delay in delivery or failure to deliver the Equipment or Service where such delay or failure is caused by fire, flood, natural causes, labor troubles (including strikes, slowdowns and lockouts), war, government regulations, riots, civil disorders, interruption of or delay in transportation, power failure, acts of nature.

15) This warranty applies to equipment supplied by the Company or works carried out by the Company and the Company shall not be liable to the Client in respect of negligence or for any indirect, special or consequential loss or damages, arising from supply of the products or their use in any way whatsoever.
